Nostios develops and publishes mobile applications for iOS, including Resonance, Block Tower Sort, and Trap the Dot, as well as the website at nostios.com (collectively, the "Services"). We may add, modify, suspend, or discontinue any part of our Services at any time without prior notice.

We reserve the right to refuse access to our Services to anyone, for any reason, at any time. We may also limit the availability of certain features or restrict access to parts of our Services without notice or liability.

Modifications

We reserve the right to modify, update, or discontinue any aspect of our Services — including features, functionality, pricing (if applicable), and availability — at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.

Accuracy of Information

We make reasonable efforts to provide accurate and up-to-date information on our website and within our apps. However, we do not warrant that any content on our Services is complete, current, or free from errors. Information may be updated or corrected at any time without notice. Any reliance on information provided through our Services is at your own risk.

Your Data

Our apps are designed to store data locally on your device. For detailed information about what data is collected, how it is used, and your rights regarding that data, please review our Privacy Policy.

You are solely responsible for maintaining and backing up the data stored by our apps on your device. Because app data is stored locally, uninstalling an app will permanently delete all associated data. Nostios is not responsible for any loss of data resulting from device failure, app removal, operating system updates, or any other cause.

If our apps offer data export functionality, we encourage you to take advantage of it regularly to safeguard your information.

Acceptable Use

You agree not to use our Services in any way that:

• Violates any applicable local, national, or international law or regulation
• Infringes upon the rights of others, including intellectual property rights
• Attempts to interfere with, compromise, or disrupt the integrity or performance of our Services
• Attempts to reverse-engineer, decompile, disassemble, or otherwise derive the source code of our applications
• Involves the distribution, reproduction, or unauthorized use of any content from our Services
• Introduces malicious code, viruses, or other harmful material to our Services

We reserve the right to terminate or restrict your access to our Services if we reasonably believe you are engaging in any prohibited activity.

Intellectual Property

All content, features, functionality, design, code, graphics, logos, trademarks, and branding associated with Nostios and its apps (collectively, "Nostios Content") are the exclusive property of Nostios and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use our apps for personal, non-commercial purposes in accordance with these terms and the applicable App Store terms. This license does not include the right to:

• Modify, adapt, or create derivative works based on our apps or website
• Copy, reproduce, or distribute any Nostios Content
• Use our branding, trademarks, or logos without prior written consent
• Use our Services for any commercial purpose without authorization

App Store Terms

Our apps are distributed through Apple's App Store. Your use of the App Store is governed by Apple's Terms of Service and the Apple Licensed Application End User License Agreement. In the event of any conflict between these terms and Apple's terms, Apple's terms will apply to the extent of the conflict.

You acknowledge that:

• These terms are between you and Nostios, not Apple. Nostios, not Apple, is solely responsible for our apps and their content.
• Apple has no obligation to provide maintenance or support services for our apps.
• In the event of any failure of an app to conform to an applicable warranty, Apple's sole obligation is limited to refunding the purchase price (if any) of the app.
• Apple is not responsible for addressing any claims by you or a third party relating to our apps, including product liability claims, regulatory compliance, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of these terms, and Apple has the right to enforce these terms against you as a third-party beneficiary.

Third-Party Links & Services

Our Services may contain links to third-party websites, services, or content that are not owned or controlled by Nostios, including but not limited to Apple's App Store, podcast hosting servers, and Apple's system services.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any third party. You acknowledge and agree that Nostios shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any third-party content, goods, or services.

We encourage you to review the terms and privacy policies of any third-party websites or services you access through our Services.

Disclaimers

Our Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• Our Services will be uninterrupted, timely, secure, or error-free
• The results obtained from the use of our Services will be accurate or reliable
• Any defects or errors in our Services will be corrected
• Our Services will be compatible with all devices, operating systems, or configurations

Limitation of Liability

• Cost of substitute products or services
• Any damages resulting from unauthorized access to or alteration of your data

This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Nostios has been advised of the possibility of such damages. In no event shall our total aggregate liability exceed the amount you paid to Nostios, if any, for the specific Service giving rise to the claim during the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the limitations above shall apply to the fullest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Nostios and its owners, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of our Services, your violation of these terms, or your violation of any rights of a third party.

Termination

These terms are effective until terminated by either party. You may terminate your agreement with these terms at any time by ceasing all use of our Services and, where applicable, uninstalling our apps.

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these terms. Upon termination, your right to use our Services will immediately cease.

All provisions of these terms which by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.

General

Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Nostios regarding your use of our Services. These terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter herein.

Waiver

Our failure to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by Nostios to be effective.

Assignment

You may not assign or transfer these terms, or any rights or obligations under them, without our prior written consent. Nostios may assign these terms without restriction.

Changes to These Terms

We may update these terms from time to time to reflect changes in our practices, products, or legal requirements. When we make changes, we will revise the "Last updated" date at the top of this page. We encourage you to review these terms periodically. Your continued use of our Services after any changes constitutes your acceptance of the updated terms.
